Agappi Dating App Terms of Service

Welcome to Agappi! These Terms of Service ("Terms") govern your use of the Agappi Dating App ("Agappi," "App," "Service"), operated by Agappi Inc. ("we," "us," or "our"), a company federally registered in Canada. By accessing or using Agappi, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

1. Eligibility

To use Agappi, you must:

• Be at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to refuse service to anyone under 19 at our discretion in jurisdictions where the age of majority is higher.

• We do not guarantee the success of any match or relationship.
• The Service is intended to facilitate meaningful connections, not to serve as a substitute for professional advice or services.

4. User Conduct

You agree to use Agappi in a manner consistent with its purpose of fostering respectful and meaningful connections. You will not:

• Harass, abuse, threaten, or discriminate against other users.
• Post or share content that is offensive, obscene, defamatory, or violates the rights of others.
• Misrepresent your identity, intentions, or personal information.
• Use the Service for commercial purposes, solicitation, or any illegal activity.
• Attempt to reverse-engineer, hack, or interfere with the functionality of the App.

We reserve the right to investigate and terminate accounts for violations of these Terms, at our sole discretion.

5. Privacy and Data Use

Your privacy is a priority at Agappi. Please review our Privacy Policy for details on how we collect, use, and protect your personal information. In summary:

• We use your data to provide and improve the Service, including refining our matching algorithm.
• We do not sell your personal data to third parties.
• You retain ownership of the content you upload, but you grant us a non-exclusive, royalty-free license to use it solely for operating and promoting the Service.

6. Safety and Community Standards

We are committed to maintaining a safe and respectful environment. You agree to:

• Report any abusive or inappropriate behavior to us promptly.
• Respect the boundaries and preferences of other users.
• Comply with our Community Guidelines.

We may suspend or terminate accounts that violate these standards, without prior notice.

7. Paid Features

Currently, Agappi is offered free of charge. In the future, we may introduce premium features, subscriptions, or other paid services ("Paid Features"). If Paid Features are introduced:

• Details of pricing, payment terms, and features will be provided at the time of purchase.
• Payments will be processed through third-party payment providers, and you agree to comply with their terms.
• All fees are non-refundable unless otherwise stated or required by applicable law (e.g., under Canadian consumer protection laws).

We will notify you of any changes to Paid Features, including pricing or availability, via the App or email.

8. Intellectual Property

All content, trademarks, and technology associated with Agappi (excluding user-generated content) are owned by Agappi Inc. or our licensors. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

9. Termination

You may delete your account at any time through the App's settings. We may suspend or terminate your access to Agappi if:

• You breach these Terms.
• We believe your use of the Service poses a risk to us, other users, or the integrity of the App.
• We discontinue the Service (with reasonable notice where possible).

Upon termination, your right to use Agappi ceases, but provisions such as Intellectual Property, Limitation of Liability, and Governing Law will survive.

10. Disclaimers

Agappi is provided "as is" and "as available." We do not warrant that:

• The Service will be uninterrupted, error-free, or free of harmful components.
• Matches will meet your expectations or lead to successful relationships.
• User-provided information is accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by Canadian law, Agappi Inc., its affiliates, and employees will not be liable for:

• Indirect, incidental, or consequential damages arising from your use of Agappi.
• Any actions or interactions between users, whether online or offline.
• Losses exceeding the amount you paid to us (if any) in the prior 12 months.

12. Indemnification

You agree to indemnify and hold Agappi Inc. harmless from any claims, losses, or damages (including legal fees) arising from your use of Agappi or violation of these Terms.

13. Modifications to the Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Your continued use of Agappi after such changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and the Province of Ontario, as Agappi Inc. is federally registered in Canada. Any disputes arising from these Terms will be resolved through binding arbitration in Toronto, Ontario, except where applicable law permits otherwise (e.g., small claims court). You waive any right to participate in a class action lawsuit against us.
